This Privacy Policy explains how Merchynt LLC ("Merchynt," "we," "us") handles personal information in connection with our websites, applications, products, paid and free services, audits and reports, AI voice and text interactions, demonstrations, lead magnets, downloads, webinars, events, marketing campaigns, support, and other business communications and interactions, online or offline (the "Services"). It includes people who inquire about our products, complete an audit, request a resource, communicate with us, or use a free feature, even if they do not become paying customers.
When we process personal information solely on behalf of a business customer, that processing is governed by our agreement with the customer and the customer's instructions. The business customer is responsible for its own privacy notices. Our separate uses of business contact information for account administration or agency and reseller referrals under Section 5 are described here.
Personal information is information that identifies, relates to, or can reasonably be linked to an individual. Business contact information can be personal information. This policy explains our practices and your choices; it does not replace a separate recording, referral, or marketing permission required by law.
You may ask to access, correct, or delete your personal information and exercise other applicable privacy rights using the methods in Section 9. To stop Merchynt marketing emails, use the unsubscribe link in the message or contact legal@merchynt.com. Service and security messages may continue where necessary.
Merchynt may initiate the agency and reseller referrals described in Section 5 without a separate request or opt-in where applicable law permits. You may opt out of agency lead referrals, future lead sales, sharing for cross-context behavioral advertising, and applicable targeted advertising by emailing legal@merchynt.com or calling 1-877-899-5327. You do not need an account, and a sale or sharing opt-out does not require identity verification. We may ask for the minimum information needed to locate the affected records. We honor legally recognized opt-out preference signals, including Global Privacy Control, where applicable law requires. Where processing relies on consent, you may withdraw that consent. If we ask whether you want an agency introduction and you decline, we honor that choice.
We communicate relevant withdrawals, opt-outs, and deletion requests to recipients as required by law and our contracts. You may also unsubscribe directly from an agency's messages. Withdrawing permission does not undo processing that was lawful before withdrawal. Recording choices and alternatives appear in Section 13. Contact us at legal@merchynt.com or Merchynt LLC, 3101 Ocean Park Blvd., Suite 100, Santa Monica, CA 90405, Attn: Privacy.
We collect personal information you provide, including your name, business contact details, role, company, business website and location, account and billing information, and preferences. This includes information submitted in audits, forms, surveys, demonstrations, downloads, events, support requests, and other communications. Audit information may include the business or profile you request us to assess, relevant scores and recommendations, and the business needs you provide.
If you use an AI voice or text feature, the interaction may include your messages, assistant responses, audio, transcripts, summaries, and contact information, subject to the notice and choices in Section 13. We also receive information from an organization or agency that is authorized to provide it about you. Some information is necessary to supply a requested feature. Opting out of agency referrals or declining a consent required by law does not prevent you from obtaining the underlying audit or resource.
Payment information may be collected through our payment processor, currently Stripe, for a purchase. Do not provide payment credentials, passwords, or confidential customer lists to an AI sales assistant. We record referral, recording, and marketing choices and related information needed to document and honor them.
When you use an audit, submit a business inquiry, request a resource, or otherwise provide information for a business interaction, we collect the business contact details and information you supply, relevant audit results and business needs, and related product interest or engagement. We use this information to provide the requested tool or response, support the business relationship, and identify relevant Merchynt or agency services. We may disclose or sell the lead categories listed in Section 5 to one agency we select so it can market its own services to you, including after you use a free tool and do not subscribe to Paige. The agency may operate under its own brand. We may receive compensation. This referral use does not require a separate opt-in where law permits it on the basis of notice and an opportunity to opt out; where consent is required, we obtain it.
We retain identifiable audit and lead information while needed to fulfill the request, administer a permitted referral, or maintain a current and relevant prospective business relationship, and then delete or deidentify it when that purpose ends or law requires. Limited legal, dispute, permission, or suppression records may remain for those purposes, as explained in Section 14. You may opt out of agency referrals and future lead sales without losing access to the audit or resource: email legal@merchynt.com, call 1-877-899-5327, or use the choices at https://www.merchynt.com/privacy#privacy-choices. Sections 3, 4, and 9 describe separately collected technical information, cookies, and applicable advertising disclosures. The complete Privacy Policy is at https://www.merchynt.com/privacy.
We collect technical and usage information such as IP address, browser and device details, approximate location inferred from IP address, referring pages, pages or features used, and dates and times of interactions. AI and voice tools may generate session identifiers, duration, connection and performance data, and other technical records. This information may identify or be linked to an individual and is not necessarily anonymous.
Information about a customer's end users that passes through our tools, including email or SMS contacts and message content, is processed for the customer's authorized purposes under the applicable agreement. We do not add that information to the agency lead program.
We may combine information from these sources to support the disclosed purposes, subject to applicable law, platform restrictions, customer agreements, and your choices. Information supplied for a customer's authorized service is not made available for unrelated agency marketing merely because it passes through our systems.
Cookies, pixels, web beacons, and similar technologies may store identifiers or collect information about how the Services are used. We use these tools for functionality, performance measurement, analytics, and applicable advertising. Contracted providers may operate these technologies. Browser settings can block or remove cookies or alert you when they are used; some features may stop working if necessary cookies are disabled. Blocking cookies does not necessarily stop all collection or all disclosures.
Google Analytics. We use Google Analytics to measure use of the Services and help improve them. Information about Google's handling of data from partner sites is available at https://www.google.com/policies/privacy/partners/. Google's browser opt-out add-on is available at https://tools.google.com/dlpage/gaoptout?hl=en.
Meta Pixel. We use Meta Pixel to measure website activity and support applicable advertising. Meta's information about cookies and controls is available at https://www.facebook.com/privacy/policies/cookies.
Microsoft Clarity. We use Microsoft Clarity to understand website use and improve the Services. Information about Clarity and its privacy controls is available at https://learn.microsoft.com/en-us/clarity/faq.
Some advertising technologies disclose online identifiers and website interaction information to advertising recipients for their own purposes. Depending on the arrangement, this may be a sale of personal information or sharing for cross-context behavioral advertising. These advertising disclosures are distinct from the one-agency lead program. Section 9 contains the historical disclosure statement and category information. You may exercise sale, sharing, and applicable targeted advertising opt-outs through Section 1. Where consent is required for nonessential cookies or similar technologies, we obtain it before activation.
A browser's general "Do Not Track" setting is different from a legally recognized opt-out preference signal. There is no uniform implementation standard for Do Not Track. Where required by applicable law, we honor Global Privacy Control and other recognized signals for sale and sharing opt-outs, including applicable advertising disclosures and agency lead sales. A signal applies to the browser or device that sends it and, when we can associate the signal with you, to associated account or lead information as required by law. If a browser signal cannot be linked to a separate offline lead record, you may identify that record using the methods in Section 1. We do not require verification of identity for a sale or sharing opt-out.
Service delivery and improvement. We use personal information to provide requested Services and resources, maintain accounts, process payments, respond to inquiries, support customers, troubleshoot, protect against misuse, measure performance, and improve our products and business practices. With the choices described in Section 13, authorized people may listen to AI conversation recordings or read transcripts to evaluate and improve our chatbot tools and identify recurring themes that inform changes to our business practices. We do not use identifiable conversation information to train or fine-tune AI models under this program.
Merchynt marketing. We use business contact information and stated preferences to provide relevant information about Merchynt and its offerings, subject to applicable permissions, marketing rules, and your choices.
Agency and reseller referrals and lead sales. We may disclose, transfer, or sell Lead Information about Merchynt's own prospective, current, or former business customers and business contacts to one agency we select. Lead Information includes your name, business email address and telephone number, business name, website, business location, role, relevant audit results, stated business needs, and relevant product interest or engagement, such as completing an audit or whether you subscribe to Paige. The recipient is one of Merchynt's agency resellers or agency partners, which may white-label Paige or other Merchynt technology under its own brand. We may receive a referral fee or other monetary or valuable consideration in connection with the referral or our relationship with the agency.
Referrals may be requested by you or initiated by Merchynt when we reasonably believe agency services may suit your business. We may ask an existing customer whether they prefer to work with an agency and, if interested, pass the customer's Lead Information to an agency. We may also refer a lead without a specific introduction request, including when someone completes a Google Business Profile audit, uses a free tool, requests a report or marketing resource, attends an event or demonstration, provides business contact information, or otherwise interacts with us in a business or marketing context and does not sign up for Paige. This use is subject to the notice, lawful basis, and choices described below.
Where applicable law permits, we provide notice at or before collection and an opportunity to opt out, and may make a referral without a separate referral checkbox or approval of the particular agency. We do not treat this approach as affirmative consent where the law requires consent. If the disclosure, collection context, new purpose, or proposed marketing channel requires consent, we obtain it before proceeding, including naming the recipient where required. We honor applicable opt-outs, objections, and recognized preference signals. If we directly invite you to receive an introduction and you decline, we honor that choice. You may also opt out through Sections 1 and 9.
The agency may contact you about its own services through channels permitted by law and your applicable choices. It may market and provide white-label services under its own name without featuring Paige, Merchynt, or the reseller relationship in its branding or sales presentation, except where a disclosure is legally required. It must identify itself accurately and provide required privacy information, including information about the source of the lead where the law requires it. The program does not permit misleading statements about whether you requested contact or how the agency obtained your information. The agency acts independently for its own marketing, and its privacy notice applies to that processing.
We send the same lead to only one independent agency and require that agency to protect the information, use it only for the disclosed referral and lawful outreach, honor applicable privacy choices and rights requests, and not resell or distribute it to another independent agency. Full AI recordings and transcripts, customer end-user records, and the other excluded information described below are not supplied as leads. A referral does not obligate you to buy from the agency or automatically transfer a Merchynt account or subscription to it.
Service providers. We disclose information to contracted providers that support payments, hosting, customer support, communications, AI processing, transcription, analytics, security, and other operations. OpenAI provides AI voice processing for our browser voice chat and AI receptionist features. Provider agreements limit processing to permitted purposes and require appropriate security. We do not opt in to OpenAI's optional sharing of conversation data for model training. Provider processing for security, abuse prevention, legal compliance, and service delivery remains subject to the applicable agreements. A reseller marketing its own services is an independent recipient, not a service provider for that activity.
Protected customer and platform data. We do not sell or disclose customer end-user records, confidential account content, authentication credentials, payment details, sensitive personal information, or information supplied solely to exercise privacy rights or verify identity through the lead program. A business customer's own business contact and lead information is distinct from information it entrusts to us about its customers, callers, or other people. Information accessed through Google APIs is handled within the applicable Google restrictions. We do not use data obtained through Google Workspace APIs to develop, improve, or train general purpose AI or machine learning models. We handle Google API information in compliance with the applicable Google API Services User Data Policy. The referral program does not expand platform permissions or override customer processing agreements.
Other disclosures. We may provide properly deidentified or aggregated information under safeguards against reidentification. We may disclose information to related entities, in a lawful business transaction, or when needed to comply with law, protect rights and security, or respond to legal process. Appropriate contractual safeguards and applicable privacy rights continue to apply. Advertising disclosures, where used, are addressed in Sections 4 and 9.
Choosing the recipient. Merchynt chooses the agency based on the business information and service needs available to us. A separate request to find a match or approval of the selected agency is not generally required where a referral is lawful on the basis described above. If a particular notice, consent, or customer request limits which recipient may receive the lead, we comply with that limitation. An agency's own business branding does not remove its legal obligations to identify itself, provide required privacy information, and respect your choices.
Sensitive information. We use sensitive personal information needed for authorized account access or integrations for those functions, security, and applicable legal obligations, rather than to infer personal characteristics. Do not submit sensitive information to an AI sales interaction. Applicable sensitive information rights and any historical uses or disclosures are addressed in Section 9.
Marketing channels. Merchynt and the selected agency may use business email and live, manually dialed calls where permitted by applicable law and your choices. They must comply with applicable unsubscribe, objection, do-not-call, and other outreach requirements. Providing contact information, using an audit or resource, accepting Terms, or agreeing to a recorded conversation does not itself supply consent required for marketing texts or automated, prerecorded, or AI voice marketing calls. Where required, the responsible sender obtains a separate written consent identifying the authorized sender, telephone number, and relevant technologies before that outreach. Consent is not a condition of purchase and may be revoked through any reasonable method permitted by law.
The Services may link to third-party sites, and we may refer Lead Information to an independent agency as described in Section 5. An agency may use its own name and brand while reselling Merchynt technology and is responsible for its own services and subsequent marketing practices. Read its privacy notice when it contacts you or before you provide additional information. Branding choices do not excuse disclosures required by law. Merchynt remains responsible for the disclosures it makes and obligations applicable law places on Merchynt; this section does not waive your privacy rights.
Third-party sites may link to, advertise, or reference our Services. A link does not itself mean Merchynt endorses the other site. Its content and collection practices are governed by its own notices, and this policy does not describe information it collects independently.
We and our contracted providers use reasonable technical and organizational safeguards appropriate to the information processed. These include limiting access to recordings, transcripts, and lead data to authorized personnel and approved recipients. Information may be stored on systems operated by Merchynt or contracted providers. No system can guarantee absolute security. Please avoid including passwords, payment credentials, or sensitive personal information in an AI sales interaction.
Our websites, direct AI sales interactions, and agency referral program are intended for adults. We do not knowingly collect personal information from children under 18 through those interactions or sell or share their personal information. If we learn that a child provided personal information, we take appropriate steps to delete it. Contact legal@merchynt.com if you believe a child has supplied information.
If a business customer's receptionist or communication feature receives information from a minor, the customer's lawful instructions and its privacy obligations apply to that processing. Such caller or end-user information is not eligible for our agency lead program.
This section describes additional rights available under applicable state privacy laws. Rights and exceptions depend on your location and whether the relevant law applies. Business contact information associated with a person can be personal information.
You may have rights to know or access the personal information we hold about you, receive a portable copy, correct inaccuracies, delete information, and opt out of its sale, sharing for cross-context behavioral advertising, targeted advertising, or certain profiling. Where applicable, you may limit certain uses of sensitive personal information, withdraw consent, use an authorized agent, and appeal a denial of a rights request. We do not discriminate against you for exercising applicable privacy rights.
Our agency and reseller referral program may involve sales of the Lead Information listed in Section 5 to independently acting agencies, including referrals Merchynt initiates after the applicable collection notice without a separate opt-in where law permits. Relevant categories are identifiers and contact information, business and commercial information including audit results and product interest or engagement, business location, professional information, and business-related inferences about service needs. In the CCPA, "sharing" has a specific meaning relating to cross-context behavioral advertising; it does not mean every ordinary disclosure. Advertising disclosures are evaluated separately. Full AI recordings or transcripts, customer end-user information, and the other excluded information in Section 5 are not sold through the agency lead program. You may opt out through Section 1.
Depending on the feature you use, we collect the categories described below. The examples do not mean that we collect every example about every person. Sources, purposes, recipient categories, and retention criteria are set out together so you can understand how a category is handled. The historical statement below describes the preceding 12 months separately from the new agency referral and AI voice practices.
| Category and examples | Sources and purposes | Recipients and retention |
|---|---|---|
| Identifiers and contact information Name, business email, telephone number, mailing address, account identifiers, and IP address. |

Used for accounts, requests, support, security, permitted marketing, and agency referrals subject to the notices and choices in Section 5. | Relevant contracted providers. Business contact details may be sold or disclosed to one selected agency under Section 5; raw IP addresses and online tracking identifiers are not agency leads. Eligible online identifiers may be disclosed to advertising recipients under Section 4. Retained under the account, lead, consent, or log criteria in Section 14. |
| Customer records and commercial information Billing contact details, payment or transaction information, products purchased or considered, audit or report information, and relevant product engagement. |

Used to supply Services, bill and support accounts, produce audits, and respond to stated business needs. | Payment and other relevant contracted providers. Relevant audit results, stated needs, and product interest or engagement may be sold or disclosed to one selected agency under Section 5; payment details are excluded. Retained under the account, transaction, or audit criteria in Section 14. |
| Internet and electronic activity Pages and features used, referrals, device and browser details, cookies, and session or connection records. |
From your browser or device and analytics or technical systems. Retained while needed for the applicable operational or advertising purpose under Section 14. |
| Approximate location Business address and approximate location inferred from IP address. |
From you, authorized business information, and your device. Used to support requested local marketing tools, security, and relevant business matching. | Relevant providers. Business location may be sold or disclosed to one selected agency under Section 5; approximate location inferred from tracking is not supplied as an agency lead. Applicable advertising disclosures may include approximate online location. Retained with the associated business, lead, or log record under Section 14. |
| Audio electronic and similar information AI audio, messages, responses, transcripts, summaries, and support communications. |
From interactions with you and the assistant; from a customer and its callers for customer-operated features. Used to deliver the interaction, support it, and conduct authorized human review described in Section 13. | OpenAI and relevant contracted communications, hosting, support, or transcription providers; authorized reviewers. Full AI recordings and transcripts are excluded from agency leads. Direct Merchynt AI records and customer call data have distinct retention rules in Section 14. |
| Professional or employment information Business role, company, business website, and stated business needs. |
From you or an organization or agency authorized to supply it. Used to respond to business requests, administer the relationship, provide relevant resources, and make agency referrals under Section 5. | Relevant contracted providers. Business role and related business information may be sold or disclosed to one selected agency under Section 5. Retained under the business relationship or lead criteria in Section 14. |
| Inferences Business interests or marketing needs inferred from the audit, requested resources, or stated preferences. |
Derived from the information and interactions described above. Used to tailor resources, assess business needs, improve Services, and support agency matching under Section 5. | Relevant contracted providers. Relevant business needs may be sold or disclosed to one selected agency under Section 5. Applicable advertising inferences follow your advertising choices. Retained only while needed for the underlying disclosed purpose under Section 14. |
| Sensitive personal information if supplied for an authorized feature Account access credentials or authentication information; sensitive information inadvertently included in an interaction. |
From you or authorized account integrations. Used where necessary for requested access, integration, security, or lawful handling of the underlying communication. We do not request sensitive personal information in an AI sales conversation. | Only relevant authorized providers or recipients required for a lawful purpose. Excluded from agency leads. Retention is limited to the necessary authorized function and applicable obligations under Section 14; unnecessary sensitive content is deleted or minimized. |
During the 12 months before October 8, 2026, Merchynt did not sell customer personal information or provide customer personal information or audit leads to resellers or agencies for their own marketing. The agency lead referral program described in this policy did not operate during that period.
Collection sources and purposes. During that period, our existing Services collected identifiers and contact information; customer records and commercial information; Internet and electronic activity; approximate location; professional or employment information; business-related inferences; and electronic information in support or other communications, as described in Sections 2 through 5. Sources included you, organizations authorized to supply business information, your browser or device, use of the Services, and relevant platform or payment providers. Purposes included fulfilling requests, maintaining accounts, processing payments, customer support, website functionality and analytics, security, and permitted Merchynt marketing.
Business purpose disclosures. We disclosed relevant identifiers, account and transaction information, technical activity, business information, and communications to the contracted payment, hosting, data management, support, communications, analytics, and security providers needed for those purposes. Payment processing included Stripe. Website analytics and measurement included Google Analytics, Meta Pixel, and Microsoft Clarity, as described in Section 4. These operational disclosures are distinct from selling or providing customer leads to an agency for its own marketing.
Website advertising disclosures. Website tracking can disclose online identifiers, Internet or electronic activity, and approximate location to analytics and advertising technology recipients, including Google, Meta, and Microsoft. For our privacy choices, we treat disclosures of these categories to advertising recipients for cross-context behavioral advertising as sharing, and as sales where applicable law classifies them that way. The recipients are analytics and advertising technology providers, including Google and Meta where their advertising functions are used. These website technology disclosures are separate from selling customer records or transferring audit leads to a reseller or agency. You may opt out through Sections 1 and 4.
Sensitive information and new features. Sensitive account access or authentication information is used for the requested function, security, and applicable legal obligations, rather than to infer personal characteristics or for agency marketing. The AI audio and transcript categories above describe the new voice features; they do not mean that recordings were collected under those new features during the preceding 12 months.
The agency and reseller referral practices in this version apply prospectively from October 12, 2026, subject to the applicable collection notices, privacy choices, lawful basis, and any required consent. Updating this policy does not by itself authorize a new use of information collected under an earlier no-sale or consent-only commitment. We obtain the permission required to change that commitment before making the information eligible for the new use.
To request access, a portable copy, correction, deletion, or another applicable privacy right, email legal@merchynt.com, call 1-877-899-5327, or write to Merchynt LLC, 3101 Ocean Park Blvd., Suite 100, Santa Monica, CA 90405, Attn: Privacy. Sale, sharing, and applicable targeted advertising opt-outs may be submitted through those methods as described in Section 1. No account is required. We do not verify identity for a sale or sharing opt-out, but may request the minimum information needed to identify the affected records. We honor applicable Global Privacy Control and other legally recognized preference signals as described in Section 4.
For access, correction, and deletion requests, we may reasonably verify identity. We respond within the deadline required by the applicable law, including generally 45 calendar days from receipt for a verified CCPA request, with an extension if law permits and we notify you. Sale and sharing opt-outs are processed as soon as feasibly possible and within the applicable shorter deadline; the CCPA maximum is 15 business days. To appeal a denial where available, email legal@merchynt.com with "Privacy Appeal" and the original request details. We explain the result and any required regulator complaint option. Statutory rights remain available whether a referral is requested by you or initiated by Merchynt.
An authorized agent may submit a request using the same contact methods. Where permitted, we may ask for evidence of the agent's authority and verification or confirmation of the underlying access, correction, or deletion request. We apply the different rules for opt-out requests and do not impose identity verification on those requests. If a right to limit a sensitive information use applies, you may request that limit at legal@merchynt.com. You may also contact us about applicable profiling or targeted advertising choices. Any exceptions are limited to those the relevant law permits.
Merchynt and its providers may process information in the United States and other countries identified in the relevant provider disclosures. Applicable local privacy rights continue to apply. Where a transfer is subject to legal restrictions, we implement an appropriate permitted transfer mechanism and safeguards before the transfer. Contact legal@merchynt.com for information about the applicable mechanism and safeguards. Using the Services does not waive mandatory protections in your jurisdiction.
Where EU or UK data protection law applies, we process information to perform a contract or take steps you request before a contract, pursue legitimate interests where your interests and fundamental rights do not override them, comply with legal obligations, or act on your consent. Relevant legitimate interests may include security, customer support, proportionate service evaluation, marketing Merchynt services, and connecting business contacts with relevant agency services. A referral or direct marketing use based on legitimate interests requires a documented assessment of the purpose, necessity, reasonable expectations, and impact on you; publishing this policy does not by itself establish that basis.
We do not assume that every agency referral or outreach can proceed without consent. Where applicable data protection or electronic marketing law requires consent for the transfer or contact method, including recipient-specific consent where required, we obtain it before proceeding. Otherwise, a referral may proceed only on an applicable lawful basis with the required transparency and your right to object. You may decline or object to agency marketing without losing access to an audit or resource.
You may have rights of access, correction, erasure, restriction, portability, and objection. You may object at any time to processing for direct marketing, including related profiling, and withdraw consent without affecting the lawfulness of earlier processing. You may complain to your supervisory authority or the UK Information Commissioner's Office. Contact legal@merchynt.com to exercise these rights or learn about legal bases, recipients, and transfer safeguards. If an agency receives your lead, it provides its own required information about its processing.
We may update this Privacy Policy and will show its effective date. We provide appropriate notice of material changes. Where a new use requires consent or would materially change a prior privacy commitment, we obtain the required permission before applying that use to previously collected information. Publishing a revised policy or your continued use alone does not supply that permission. You retain applicable privacy rights and choices. Information not eligible for a newly introduced use remains subject to the relevant earlier commitments.
OpenAI provides AI voice processing for our browser voice chat and AI receptionist features. We identify the assistant as AI and explain the recording and transcription practice before requesting affirmative permission. After agreement, Merchynt, OpenAI, and other identified contracted providers may process audio, messages, responses, transcripts, summaries, and session information to deliver the interaction. Authorized people may listen to recordings or read transcripts to find ways to improve our chatbot tools and revise business practices when recurring themes emerge. You may decline the recorded feature and contact us through hello@merchynt.com for sales questions or support@merchynt.com for customer support.
Recording permission is separate from the rules for agency referrals and marketing. Business contact details and stated business needs you provide in a direct Merchynt interaction may be eligible for a referral under Section 5, subject to the applicable collection notice, privacy choices, lawful basis, and any consent required by law. Agreeing to recording does not itself supply a consent required for a referral or for marketing texts or automated, prerecorded, or AI voice marketing calls. Full recordings and transcripts are not sold or provided as agency leads. Avoid providing sensitive personal information, credentials, or other people's private data.
We do not use identifiable conversation information to train or fine-tune AI models, and we do not opt in to OpenAI's optional model-training data sharing. Any future model-training use requires a separate review, notice, and appropriate permission before it begins. Merchynt's recording retention is distinct from provider storage and security logging. See Section 14 for retention and deletion requests at legal@merchynt.com.
Where an AI receptionist answers for a business customer, that business is identified to the caller and its privacy notice applies. Merchynt and its providers process call data under the customer agreement and authorized instructions. Human review for improvement must be permitted by that agreement and supported by the applicable caller notices and permissions. The customer's lawful retention instructions apply; customer caller data is not part of Merchynt's agency lead program.
For a voice interaction, the required recording permission is obtained before recording and transcription begin. Where required, all participants must consent. You may end the interaction at any time. A text interaction processes the messages you submit as described in the notice for that feature. AI output may be inaccurate; confirm material product, pricing, or contractual information with Merchynt. If the interaction is with a business customer's receptionist, use that business's alternative contact method if you decline the recorded feature.
AI recordings and transcripts of direct Merchynt interactions have no fixed automatic expiry. Where lawful, we may keep them for continuing human review to improve our chatbot tools and revise business practices based on recurring themes. This can involve long-term retention. We regularly assess continuing need, the age and sensitivity of the information, whether less identifying information would suffice, applicable permissions, and contractual and legal requirements. We delete or properly deidentify information when it is no longer reasonably necessary for the disclosed purposes or when law requires, even without a deletion request.
You may request deletion of your recordings and transcripts at any time by emailing legal@merchynt.com or using the applicable request methods in Section 9. To help locate an interaction, include its approximate date, the channel used, and a relevant contact or session identifier if available; do not email credentials or unnecessary sensitive information. Following reasonable verification where needed, we delete eligible identifiable records and direct contracted providers to delete them as applicable. Limited records may remain where law permits or requires, such as for a legal obligation, security, a dispute, or consent and suppression evidence. We explain any applicable exception and restrict retained information to that purpose.
Customer call data. AI receptionist data processed on a customer's behalf follows that customer's agreement and lawful retention instructions. Customer callers should generally direct requests to the business whose receptionist they contacted; Merchynt assists the business as required by the applicable agreement and law. This data does not automatically follow the retention approach for direct Merchynt sales conversations.
Audits and referral leads. We retain identifiable audit and referral records while needed to fulfill the request, administer a permitted referral, or maintain a current and relevant prospective business relationship. We review older or inactive records and delete or deidentify them when that purpose ends, when information becomes outdated, when law requires, or when an applicable withdrawal or objection ends the lawful basis for retaining them. An opt-out stops the covered referral or marketing use; limited information may remain for another lawful purpose such as providing your requested Service, demonstrating notice or permission, responding to a dispute, or honoring an opt-out.
Accounts and transactions. We retain account information during the relationship and afterward only as needed for documented legal, tax, accounting, security, or dispute requirements. Payment and transaction records are retained for the applicable legal recordkeeping period. The period depends on the record, jurisdiction, and obligation; it does not authorize unrelated marketing.
Notices permissions and suppression records. We retain the minimum information needed to document the notice given, the applicable basis and any required consent, handle a complaint, comply with law, and prevent future contact or transfers you have rejected. These records are restricted to those purposes and reviewed for continued need. A deletion request may therefore leave a limited suppression record to ensure that we honor your preferences.
Logs cookies and provider records. Technical and security logs are retained while reasonably needed for the relevant operational, fraud prevention, troubleshooting, or legal purpose. Cookie and advertising information follows the necessary purpose, applicable permissions, and configured technology or provider schedule. We review these periods and remove or deidentify information when it is no longer needed. Provider storage and security logs can follow a different schedule from Merchynt's own recordings, subject to applicable agreements and law.
Backups. Deleted information may remain temporarily in restricted backups until it is removed through the documented rotation process. It is excluded from routine use and is subject to deletion again if restored. A legally required preservation is restricted to the reason for retaining it.
Deletion and retention exceptions do not authorize renewed marketing or sale after you opt out. Information retained only to meet a legal obligation or honor a suppression request is restricted to that purpose.
Questions about this policy or retention may be sent to legal@merchynt.com or to Merchynt LLC, 3101 Ocean Park Blvd., Suite 100, Santa Monica, CA 90405, Attn: Privacy.
